What changed
Following the Supreme Court's ruling in February 2026, duties collected under certain IEEPA (International Emergency Economic Powers Act) tariff actions became recoverable. That opened one of the largest import-duty refund opportunities in recent memory, and most eligible importers still have not filed.
The scale of it
CBP has processed $121.75 billion in tariff refund claims. The money is real and it is moving. The gap is that the vast majority of eligible importers are not set up to claim, so a large share of what is owed is still sitting unclaimed.

What are IEEPA duty refunds?
IEEPA duty refunds are repayments of tariffs imposed under the International Emergency Economic Powers Act and ruled unconstitutional by the U.S. Supreme Court in February 2026. Importers who paid them between February 4, 2025 and February 24, 2026 are entitled to a full refund plus statutory interest.
What is the deadline to file an IEEPA duty refund claim?
February 4, 2027 for fentanyl tariffs on goods from China, Mexico, and Canada, and April 5, 2027 for reciprocal tariffs on goods from all other countries. Missing these deadlines permanently forfeits your refund.
