Definition
The importer of record is the party legally responsible for an import entry: for declaring the goods, paying the duties, and ensuring the entry is accurate. It is the business whose name is on the entry with CBP.
The responsibilities
Being importer of record carries obligations. You are responsible for correct classification, correct valuation, correct duty, and for keeping records. CBP holds you to a reasonable care standard on all of it. The role is not just a label. It is accountability.
Why it decides refund eligibility
Because the importer of record paid the duties, that party is the one positioned to recover them. A downstream buyer who paid more because of tariffs felt the cost but did not pay CBP directly, so they cannot file. The right to a refund follows the party that paid the duty.
